Massachusetts Education LawyersEvery child has a right to a public education. State and federal laws reinforce this by requiring special education for children with disabilities. Despite the existence of these laws, children are often denied the education they deserve. At Dolan Connly, PC, our attorneys help children obtain needed educational services. Children with a disability must receive accommodation in school The law requires that public schools provide accommodations that will allow disabled children to attend and learn. These accommodations can take many forms, such as providing tutors or making private school placements. Some children may need extra time to take required tests. Others may require school materials to be enlarged so they can be read. Because each child's situation is different, his or her need for special services will differ. Schools are required to make every reasonable effort to accommodate a child's needs. Requirements of special education lawsThe Individuals with Disabilities Act (IDEA) mandates assessment and testing to establish a child's need for special education services. It also requires that the school work with the parents to develop an individualized education program (IEP) for the child and meet at least annually to review the plan. Finally, it requires parents and schools to resolve disputes about a child's education through mediation or another impartial process. Attending hearings and team meetingsIn Massachusetts, one process for resolving disputes about special education involves a due process hearing at the Massachusetts Department of Education and the Bureau of Special Education Appeals. This hearing is like a trial, with witnesses and evidence. Because of the courtroom experience of our attorneys, we are well equipped to appear at such hearings, and have represented many parents and children over the years. Our lawyers also attend team meetings at the school when needed, representing families in matters such as transition services or changes to an IEP.
