The penalties for drunk driving in Massachusetts are stiff and increasingly inflexible. The Commonwealth has a per se law, which means if a driver's blood alcohol (BAC) level is above .08 percent, he or she is assumed to be impaired, even if there is no other evidence of intoxication. Refusal to take a breathalyzer test cannot be admitted in court; however, this refusal will result in the loss of the driver's license for a minimum of 180 days. If the driver was under 21, the penalties become more complex, with concurrent license suspensions imposed for refusal to take a breathalyzer test. If the driver has had prior convictions for DUI, the penalties for an additional conviction increase and can include jail time.
